Elovee, Inc. and its authorized agents, licensees, and affiliated Provider (collectively, “Elovee,” “we,” or “us”), require that all visitors, users, and others who access or use the websites **https://elovee.com/** or other websites controlled by Elovee (“Websites”) or our mobile application (“Application”), both controlled by Elovee (collectively, the “Platform”) and receive services available to users through the Platform (“Services”) adhere to the following terms and conditions of use (“Terms”). By accessing and using the Platform, you accept and agree, on your own behalf and on behalf of any company, organization, institution or other legal entity that you represent or for which you access the Platform (“Company”, “Organization”, “Institution”, or “you”), to be bound by and comply with these Terms and to comply with all applicable laws and regulations. PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING THE PLATFORM. If you do not agree to these Terms, you are not authorized to access or use the Platform.
This Agreement contains a mandatory arbitration provision that, as further set forth in Section 21 below, requires the use of arbitration on an individual basis to resolve disputes, rather than jury trials or any other court proceedings, or class actions of any kind. YOUR COMPLIANCE WITH THESE TERMS IS A CONDITION TO YOUR USE OF THE PLATFORM. IF YOU DO NOT AGREE TO BE BOUND BY THE TERMS OF USE, PROMPTLY EXIT THE PLATFORM.
Elovee provides a Platform that enables users to identify, engage with and receive healthcare services from Provider. Elovee is NOT a healthcare provider, but rather has entered into an agreement with Provider to provide certain services.
Provider is Elovee Therapy Services, P.A., a professional services corporation, including any licensed, accredited, or certified healthcare professionals employed by, leased by, or otherwise contracted with Elovee. The Provider has entered into a contractual arrangement with Elovee to receive certain services, including being listed as a provider on the Platform and being granted access to the Platform to provide telehealth services to patients.

Elovee does not provide healthcare services. All of the Providers are affiliated through contracts with Elovee and use the Platform as a way to communicate with you. Any information or advice received from a Provider comes from the provider alone, and not from Elovee. Your interactions with the Provider via the Platform are not intended to take the place of your relationship with your regular health care practitioners. Neither Elovee, nor any of its subsidiaries or affiliates or any third party who may promote the Platform or provide a link to the Platform, shall be liable for any professional advice obtained from a Provider via the Platform or for any other information obtained on the Platform.
Elovee does not endorse any specific tests, healthcare provider, medications, products or procedures that are recommended by Provider that may use Elovee to communicate with you. You acknowledge that your reliance on any Provider or information provided by the Provider or via the Platform or Services is solely at your own risk and you assume full responsibility for all risk associated herewith.
Elovee does not make any representations or warranties about the training or skill of any Provider who provide services via the Platform or Services. Any ratings, comments, or testimonials appearing on the Platform about a specific Provider were generated from user responses or data only, and do not reflect or represent any endorsement or recommendation by Elovee.
You will be provided with a list of Provider participating with Elovee who are available to provide professional services where you are located. Elovee does not make any representations or warranties about the training or skill of any Provider who provide services via the Platform. While Elovee does reasonably vet the Providers appearing on the Platform, since the information received by Elovee is provided by the Provider, Elovee cannot legally guarantee the accuracy or truthfulness of the verification of degrees, qualifications, licensure, certification, credentials, competence, or background of any Provider. You are ultimately responsible for choosing your particular Provider.
We reserve the right, at our sole discretion, to change, modify, add, or remove portions of these Terms at any time. All such changes are effective immediately upon notice, which we may give by any means, including, but not limited to, by posting such changes or other notice on the Platform. You should check these Terms each time you access the Platform to stay informed of changes that may affect you. Your continued use of the Platform following the posting of changes means that you understand, accept and agree to the changes.
Information that you provide to us or that we collect about you and your Company / Organization / Institution through your access to and use of the Platform is subject to our Privacy Policy, any medical information collected about you will be governed by the Provider’s Notice of Privacy Practices (“Provider’s NPP”). We encourage you to read and become familiar with our Privacy Policy and each Provider’s NPP.
You understand and agree that we own, control, or (where applicable) license from third parties, all right, title, and interest in and to the Platform and any information, text, data, databases, graphics, images, sound recordings, audio and visual clips, logos, software, opportunities, features, services, and other materials within the Platform (all such materials, and any compilation, collection, or arrangement thereof, collectively, the “Content”). You acknowledge and agree that the Content constitutes valuable proprietary information that is protected by applicable intellectual property and other proprietary rights, laws, and treaties of the United States and other countries, and that you acquire no ownership interest by accessing or using the Platform or the Content. Such intellectual property and proprietary rights may include, but are not limited to, copyrights, trademarks and service marks, trade dress, and trade secrets, and all such rights are the property of Elovee or its licensors and content providers.
